Service of petition on the Commissioner of Labor by the board.
Department of Labor
- (a) After a petition is filed that complies with section 65.18 of this Part, the board will serve it upon the commissioner, through their General Counsel. Acknowledgment of service in a form determined by the board will be sent to all parties indicating the date the petition was served.
- (b) If the petition seeks review of a decision issued under Labor Law section 30 or of a notice of violation and order to comply issued under Labor Law section 27-a, the board will send a copy of the petition for informational purposes to any representative of the affected employees identified in the petition.
