1. (a) The application is completed, signed by an appropriate individual, and submitted to the department.
2. (b) The applicant is an individual, corporation, partnership or other entity that is legally authorized to do business in New York State. If the applicant is seeking a specific license pursuant to section 16.123 of this Part, the applicant shall be legally authorized to practice medicine in New York State or operate a hospital as defined in section 2801 of the Public Health Law.
3. (c) The applicant satisfies the requirements set forth in section 16.103 of this Part.
4. (d) The applicant demonstrates to the satisfaction of the department that it has adequate facilities for clinical care of patients.
5. (e) The applicant demonstrates to the satisfaction of the department that its facilities will be appropriately equipped and staffed and will be operated as required by this Part.
6. (f) The applicant provides additional information as requested by the department.

An application seeking a specific license for use of radioactive materials on human beings shall be approved if all of the following criteria are satisfied:
