1. (a) Department means the New York State Department of Agriculture and Markets.
2. (b) Adjudicatory proceeding means any activity in which a determination of the legal rights, duties or privileges of named parties thereto is required by law to be made only on a record and after an opportunity for a hearing, provided that rule making proceedings and employee disciplinary actions before the department shall not be adjudicatory proceedings for the purposes of this Part.
3. (c) Person means any individual, partnership, corporation, association or public or private organization of any character other than the department.
4. (d) Party means any person or agency named or admitted as a party or properly seeking and entitled as of right to be admitted as a party; but nothing herein shall be construed to prevent the department from admitting any person or agency as a party for limited purposes.

For the purposes of this Part, the following terms shall have the following meanings:
