N.Y. Tax Law § 1609
a. Lottery tickets shall be in such form as the division may prescribe. No ticket shall be sold at a price greater than that fixed by the division nor shall a sale be made by any person other than a licensed lottery sales agent, and a violation of these provisions shall be a misdemeanor, but this shall not be deemed to prevent any person from giving lottery tickets as premiums to customers, employees or other dealing with him. b. 1. Notwithstanding any inconsistent provision of any other law, rule or regulation, any contract for the printing or purchase of tickets shall only be awarded after bids made on specifications compiled and advertised in the manner provided by law for the advertisement of contracts for the purchase of materials and supplies, by the commissioner of general services and only to the lowest responsible bidder as that term is herein defined.
