N.Y. Insurance Law § 4306-H
(a)
(1) For purposes of this article, "essential health benefits" shall mean the following categories of benefits:
(2) A corporation shall not be required to provide coverage for pediatric oral services as an essential health benefit if:

(1) Every individual and small group contract that provides hospital, surgical, or medical expense coverage and is not a grandfathered health plan shall provide coverage that meets the actuarial requirements of one of the following levels of coverage:
