“Distributor” means a person:

1. 1. Whose primary business is the wholesale distribution of commercial goods for resale;
2. 2. Who maintains an inventory of commercial goods for resale;
3. 3. Who has the right to sell or distribute commercial goods in this State for resale to retailers or other resellers or to an industrial or commercial manufacturer; and
4. 4. Who conducts business in this State.
