1. 1. An employee of the State Department of Agriculture or the Board or an attorney who represents the Department or Board who, in the course of his or her duties:

   1. (a) Possesses, delivers or produces cannabis;
   2. (b) Aids and abets another in the possession, delivery or production of cannabis;
   3. (c) Performs any combination of the acts described in paragraphs (a) and (b); or

   4. (d) Performs any other criminal offense in which the possession, delivery or production of cannabis is an element,

      is exempt from state prosecution for the offense. The persons described in this subsection must ensure that the cannabis described in this subsection is safeguarded in an enclosed, secure location.

2. 2. In addition to the provisions of subsection 1, no person may be subject to state prosecution for constructive possession, conspiracy or any other criminal offense solely for being in the presence or vicinity of the cannabis in accordance with the provisions of this title.
3. 3. As used in this section, “cannabis” includes, without limitation, cannabis products.
