Any person who is:

1. 1. Engaged in vending, selling, offering for sale or delivering directly to the public any newspaper, magazine or periodical pursuant to an agreement or contract with the publisher or distributor thereof;
2. 2. Acting under the control of the publisher or distributor; and

3. 3. Receiving a wage, commission or other compensation based upon the person’s sales of the newspaper, magazine or periodical,

   shall be deemed, for the purposes of chapters 616A to 616D, inclusive, of NRS, to be an employee of the publisher or distributor and to be receiving a wage of $50 per month or the person’s actual remuneration, whichever is greater, and is entitled to the benefits of those chapters.
