1. 1. Any person violating any of the provisions of NRS 555.500 to 555.560, inclusive, or failing, refusing or neglecting to perform or observe any conditions or regulation prescribed by the State Board of Agriculture, in accordance with the provisions of NRS 555.500 to 555.540, inclusive, is subject to a civil penalty not to exceed:

   1. (a) For the first violation, $250.
   2. (b) For a second violation, $500.
   3. (c) For each subsequent violation, $1,000.

2. 2. Any money collected from the imposition of a civil penalty pursuant to subsection 1 must be accounted for separately and:

   1. (a) Fifty percent of the money must be used to fund a program selected by the Director that provides loans to persons who are engaged in agriculture and who are 21 years of age or younger; and
   2. (b) The remaining 50 percent of the money must be deposited in the Account for the Control of Weeds established by NRS 555.035.
