1. 1. A natural person who violates subsection 1 of NRS 449A.186:

   1. (a) For a first offense, is liable for a civil penalty not to exceed $5,000.

   2. (b) For a second and any subsequent offense:

      1. (1) Is liable for a civil penalty not to exceed $10,000 for each violation; and
      2. (2) Is guilty of a misdemeanor.

2. 2. In addition to any disciplinary action imposed pursuant to chapter 449 of NRS, a covered facility or any person, partnership, association or corporation establishing, conducting, managing or operating a covered facility who violates subsection 1 or 5 of NRS 449A.186:

   1. (a) For a first offense, is liable for a civil penalty not to exceed $10,000.

   2. (b) For a second and any subsequent offense:

      1. (1) Is liable for a civil penalty not to exceed $20,000 for each violation; and
      2. (2) Is guilty of a misdemeanor.
3. 3. The Attorney General or any district attorney may recover any civil penalty assessed pursuant to this section in a civil action brought in the name of the State of Nevada in any court of competent jurisdiction.
