1. 1. The Division shall certify an assisted living facility for the purpose of providing services pursuant to the provisions of the home and community-based services waiver which are amended pursuant to NRS 422.3962 if the facility:

   1. (a) Provides assisted living supportive services to senior citizens of low or moderate income;
   2. (b) Provides or arranges for the provision of case management services for its residents;
   3. (c) Guarantees attainable housing for a period of at least 15 years after the facility is certified;
   4. (d) Is financed through tax credits relating to low-income housing or other public funds; and
   5. (e) Satisfies any other requirements set forth by the Division in any regulations adopted by the Division.
2. 2. The Division shall adopt regulations concerning the certification of assisted living facilities pursuant to this section.

3. 3. As used in this section:

   1. (a) “Assisted living facility” has the meaning ascribed to it in paragraph (a) of subsection 3 of NRS 422.3962.
   2. (b) “Assisted living supportive services” has the meaning ascribed to it in paragraph (b) of subsection 3 of NRS 422.3962.
