1. 1. Except as otherwise provided in subsection 2, a principal may not name as agent in a power of attorney for health care:

   1. (a) His or her provider of health care;
   2. (b) An employee of his or her provider of health care;
   3. (c) An operator of a health care facility; or
   4. (d) An employee of a health care facility.
2. 2. A principal may name as agent any person identified in subsection 1 if that person is the spouse, legal guardian or next of kin of the principal.
