1. 1. Except as otherwise provided in subsection 2:

   1. (a) A child in the custody of an agency which provides child welfare services may be adopted by one or more adults with whom the child is placed by the agency which provides child welfare services and subject to the rules prescribed by this chapter;
   2. (b) A person adopting a child must be at least 10 years older than the person adopted; and
   3. (c) If the child is over the age of 14 years, the child must agree to the adoption.

2. 2. A court may approve the adoption of a child without regard to the age difference of the child and a prospective adoptive parent if:

   1. (a) The prospective adoptive parent is related to the child within the third degree of consanguinity; and
   2. (b) The court is satisfied that it is in the best interest of the child.
