N.M. Stat. Ann. § 70-2-37
There is created the "oil and gas reclamation fund". In addition to other sources, money in the fund may consist of donations. All funds in the oil and gas reclamation fund are appropriated to the energy, minerals and natural resources department for use by the oil conservation division in carrying out the provisions of the Oil and Gas Act.

The 2010 amendment, effective May 10, 2010, added the second sentence.
The 1989 amendment, effective April 7, 1989, deleted "and the earnings therefrom" following "gas reclamation fund" in the second sentence.
The 1987 amendment, effective July 1, 1987, substituted "energy, minerals and natural resources" for "energy and minerals" and made a minor language change.
70-2-37. Oil and gas reclamation fund created; disposition of fund. (Effective July 1, 2027.)
The "oil and gas reclamation fund" is created as a nonreverting fund in the state treasury. In addition to other sources, money in the fund may consist of distributions, appropriations, gifts, grants and donations. The energy, minerals and natural resources department shall administer the fund, and money in the fund is appropriated to that department for use by the division in carrying out the provisions of Section 70-2-38 NMSA 1978.

The 2026 amendment, effective July 1, 2027, amended how money in the oil and gas reclamation fund may be used, and defined the fund as a nonreverting fund in the state treasury administered by the energy, minerals and natural resources department; after "oil and gas reclamation fund'" added "is created as a nonreverting fund in the state treasury", after "energy, minerals and natural resources department" added "shall administer the fund, and money in the fund is appropriated to that department", deleted "oil conservation" preceding "division" and after "carrying out the provisions of" deleted "the Oil and Gas Act" and added "Section 70-2-38 NMSA 1978".
