The superintendent may, in his sole discretion, authorize use of a policy form having a lower score than the Flesch reading ease score required in Paragraph A(1) of Section 362 [59A-19-4 NMSA 1978] of this article if he finds that a lower score:

1. A. will provide a more accurate reflection of the readability of a policy form;
2. B. is warranted by the nature of a particular policy form or type or class of policy forms; or
3. C. is caused by certain policy language which is drafted to conform to requirements of any state law, regulation or agency interpretation.
