Gaming application violates law prohibiting any person from accepting for profit anything of value to be transmitted or delivered for gambling. — This section bans accepting a monetary fee for pari-mutuel wagering "on the results of a race, sporting event, contest or other game of skill or chance or any other unknown or contingent future event or occurrence whatsoever" and therefore a gaming application, which, for a fee, allows individuals to play state lottery games online using mobile devices or computers, violates this section of the New Mexico Lottery Act. 2025 Op.
