As used in the Special Medical Needs Act:

1. A. "department" or "division" means the income support division of the health care authority;
2. B. "board" means the division;
3. C. "aged person" means a person who has attained the age of sixty-five years and does not have a spouse financially able, according to rules of the division, to furnish support;
4. D. "person with a disability" means a person who has attained the age of eighteen years and is determined to have a permanent and total disability, according to rules of the division; and
5. E. "blind person" means a person who is determined to be blind according to rules of the division.

ANNOTATIONS

The 2024 amendment, effective July 1, 2024, provided that references to "department" or "division" mean the income support division of the health care authority and made conforming changes; changed "regulations" to "rules" throughout the section; and in Subsection A, after "division of the" deleted "human services department" and added "health care authority".

The 2007 amendment, effective June 15, 2007, made non-substantive language changes.
