Federal food and drug administration-approved products that contain psilocybin shall be exempt from the Medical Psilocybin Act, with the exception that such products shall be authorized for use:

1. A. in any research conducted by state research universities or health care providers pursuant to grants awarded through the medical psilocybin research fund; and
2. B. by qualified patients whose treatments may be funded through the medical psilocybin treatment equity fund.

ANNOTATIONS

Effective dates. — Laws 2025, ch. 73 contained no effective date provision, but, pursuant to N.M. Const., art. IV, § 23, was effective June 20, 2025, 90 days after adjournment of the legislature.
