Subject to the provisions of Section 8 [24-6B-8 NMSA 1978] of the Jonathan Spradling Revised Uniform Anatomical Gift Act, an anatomical gift of a donor's body or part may be made during the life of the donor for the purpose of transplantation, therapy, research or education in the manner provided in Section 5 [24-6B-5 NMSA 1978] of the Jonathan Spradling Revised Uniform Anatomical Gift Act by:

1. A. the donor, if the donor is an adult or if the donor is a minor and is:

   1. (1) emancipated; or
   2. (2) authorized pursuant to state law to apply for an instruction permit because the donor is at least fifteen years of age;
2. B. an agent of the donor, unless the power of attorney for health care or other record prohibits the agent from making an anatomical gift;
3. C. a parent of the donor, if the donor is an unemancipated minor; or
4. D. the donor's guardian.

ANNOTATIONS

Effective dates. — Laws 2007, ch. 323, § 36 made the Jonathan Spradling Revised Uniform Anatomical Gift Act effective July 1, 2007.
