N.M. Stat. Ann. § 22-30-3
The "statewide cyber academy" is created as a program in the department. The statewide cyber academy may provide distance learning courses for sixth grade through twelfth grade and professional development for teachers, instructional support providers and school administrators.

The 2026 amendment, effective July 1, 2026, removed the requirement that the statewide cyber academy be a collaborative program, and made certain technical amendments; after "in the department", deleted "The statewide cyber academy is a collaborative program among the department, the higher education department, telecommunications networks and representatives of other state agencies engaged in providing distance education.", and after "learning courses for" deleted "grades six through twelve" and added "sixth grade through twelfth grade.".
