1. A. Unlawful possession of keys consists of, under color of law or otherwise, the possession at any time of any key to a voting machine, ballot box or monitored secured container, or possession of an imitation or duplicate thereof, or making or causing to be made any imitation or duplicate thereof, unless authorized by the Election Code.
2. B. Whoever commits unlawful possession of keys is guilty of a fourth degree felony, in addition to any other offense provided by law.

ANNOTATIONS

The 2026 amendment, effective May 20, 2026, prohibited persons acting under color of law or otherwise from unlawful possession of keys; added new subsection designations "A" and "B"; in Subsection A, after "consists of" added "under color of law or otherwise"; and in Subsection B, after "fourth degree felony" added "in addition to any other offense provided by law".

The 2023 amendment, effective June 16, 2023, revised the definition of the crime of unlawful possession of keys; and after "ballot box", added "or monitored secured container".
