A scholarship is terminated upon the occurrence of one or more of the following:

1. A. Withdrawal by the recipient from the institution to which the recipient was granted the scholarship to attend. In the event the recipient seeks to transfer the scholarship to another institution the recipient must notify and obtain prior approval from the department.
2. B. Failure to achieve satisfactory academic progress by the recipient as determined by the educational institution.

3. C. Substantial noncompliance by the scholarship recipient with the fire fighters and peace officer survivors scholarship act or the rules, regulations or procedures promulgated by the state of New Mexico higher education department.
