N.M. Code R. § 3.9.1.20
Right of Appeal: Any person may appeal the department’s determination that cigarettes seized are contraband under Subsection B of Section 7-12-2 NMSA 1978, and any imposition of civil penalties authorized by Section 7-12-13.1 NMSA 1978. Any person may appeal the department’s decision to deny, suspend or revoke the issuance of a cigarette distributor or manufacturer license.
