PROHIBITED ACTIVITY AND CREDIBLE EVIDENCE

1. A. Failure to comply with the emissions standards, monitoring, recordkeeping, reporting or other requirements of this Part within the timeframes specified shall constitute a violation of this Part subject to enforcement action under Section 74-2-12 NMSA 1978.

2. B. If credible evidence or information obtained by the department or provided to the department by a third party indicates that a source is not in compliance with the provisions of this Part that evidence or information may be used by the department for purposes of establishing whether a person has violated or is in violation of this Part.
