The owner or operator of a new nonferrous smelter shall not permit, cause, suffer or allow:

1. A. sulfur emissions to the atmosphere in excess of ten pounds of sulfur for every one hundred pounds of sulfur fed to the smelter;

2. B. the release of fugitive sulfur emissions to the atmosphere unless best engineering practices, including practices listed in subsection E of 20.2.41.109 NMAC, are utilized to minimize the release of such fugitive emissions.
