If a respondent does not mail a request for a hearing within the time frame and in the manner required by this rule, or the notice mailed by the department is returned as undeliverable or unclaimed at the address the department has on file, the commission may take the action contemplated in the notice and such action shall be final and not subject to judicial review.

1. A. The commission shall consider the department's submission of names of respondents who have not requested a hearing at a properly scheduled commission meeting and the respondent’s privileges shall be automatically revoked or suspended pursuant to this rule.
2. B. Within 20 days after the commission's decision is rendered and signed by the chairperson of the commission, the department shall serve upon the respondent a copy of the written decision.
