N.M. Code R. § 19.21.2.20
The prohibition on removing, harming, killing or destroying endangered plants without a permit issued by the state forester shall not apply to ground-disturbing activities for which a person received a permit or similar authorization from a federal, state or local government agency prior to April 25, 2023 so long as the ground disturbance commences by October 22, 2023.
