For the purposes of this rule:

1. A. “Impaired Health Care Provider Act” refers to Section 61-7-1 through Section 61-7-12 NMSA 1978 (1995 Repl. Pamp.).
2. B. “Controlled Substances Act” refers to Section 30-31-1 through Section 30-31-42 NMSA 1978.

3. C. “Impaired practitioner” means any health care provider unable to practice with reasonable skill or safety to patients by reason of one or more of the following: mental disorder or illness; physical illness, including but not limited to deterioration through the aging process or loss of motor skill; or habitual or excessive use of alcohol or abuse of drugs, as defined in the Controlled Substances Act.
