1. A. Any person may bring an allegation of prohibited conduct under the act, including criminal fraud, bad faith, unfair claims processing, retaliation, or non-compliance with the requirements of the act, to the attention of the WCA’s enforcement bureau.
2. B. Any party may initiate a charge of bad faith, unfair claims processing, or retaliation by the filing of a complaint or an application to a judge.
3. C. The director may initiate an investigation of any act or pattern of action with potential for adverse impact upon the workers’ compensation system by referring the matter for investigation to the enforcement bureau.
