1. (a) Except as specified in (c), below, it shall be the responsibility of the well owner to have an abandoned well sealed.
2. (b) Upon completing a replacement well installation, a licensed water well contractor shall inform the well owner of the requirements of We 603 and We 604, pertaining to maintenance and abandonment of the existing well.

3. (c) A licensed water well contractor shall be responsible for sealing:

   1. (1) A failed borehole, or

   2. (2) An abandoned well if the abandonment:

      1. a. Resulted from improper well construction, and
      2. b. Occurred within 12 months of the date of construction.
