1. (a) Any party or intervenor may make a motion to compel compliance with an information or document request.

2. (b) A motion to compel the production of requested information or documents shall be filed:

   1. (1) At least 30 calendar days before the scheduled hearing; or

   2. (2) If there are not 30 calendar days left before the scheduled hearing, as soon as possible after:

      1. a. Receipt of a refusal to respond timely and completely to the request for voluntary production; or
      2. b. The passing of time sufficient for a response to the request for voluntary production without receipt of either a response or an explanation for the failure to respond.
