1. (a) Department-managed projects shall be awarded to the lowest responsible bidder in a competitive bidding process conducted in accordance with RSA 228:4 and RSA 228:4-a. A department-managed project shall be administered by the department.

2. (b) A municipally-managed project shall be performed by a construction provider, under the following conditions:

   1. (1) The construction provider was selected as the lowest responsible bidder in a competitive bidding process;
   2. (2) The municipality has submitted a tabulation of the bids received in the competitive bidding process to the department; and

   3. (3) The department has concurred in the contract award after considering the following, including, but not limited to:

      1. a. The reasonableness of the unit prices in the bids; and
      2. b. If the construction provider is not prequalified in accordance with Tra 401, the experience of the construction provider in the type of work anticipated in the project.
3. (c) During construction, the work shall be inspected by the department as necessary to ensure conformity with the approved plans and specifications.
