1. (a) Upon the motion of any party, or upon his or her own initiative, and following notice and an opportunity for hearing to all affected persons, the presiding officer may suspend or waive any requirement or limitation imposed by this chapter when:

   1. (1) The proposed waiver or suspension appears to be lawful; and
   2. (2) The proposed waiver or suspension would be more likely to promote the fair, accurate and efficient resolution of issues pending before the department than would adherence to the rule or procedure.
