1. (a) The committee consists of the following 9 persons, except as otherwise provided in (b) below:

   1. (1) The commissioners of the commission;
   2. (2) The commissioner of the department of environmental services;
   3. (3) The commissioner of the department of resources and economic development;
   4. (4) The commissioner of the department of transportation;
   5. (5) The commissioner of the department of cultural resources or the director of the division of historical resources as designee; and
   6. (6) Two members of the public appointed pursuant to RSA 162-H:3, I (f), except in any matter for which an alternate public member is appointed pursuant to RSA 162-H:3, XI.
2. (b) If at any time a member who is a state employee must recuse himself or herself on a matter, or is not otherwise available for good reason, such member shall designate a senior administrative employee or a staff attorney from his or her agency to sit on the committee.

3. (c) The committee shall be responsible for the following:

   1. (1) Evaluation and issuance of any certificate for an energy facility under RSA 162-H and these rules;
   2. (2) Determination of the terms and conditions of any certificate issued under RSA 162-H and these rules;
   3. (3) Adjudication and determination of any petition filed under RSA 162-H and these rules;
   4. (4) Monitoring of the construction and operation of any energy facility issued a certificate under RSA 162-H and these rules to ensure compliance with such certificate;
   5. (5) Enforcement of the terms and conditions of any certificate issued under RSA 162-H and these rules; and
   6. (6) Assistance to the public in understanding the requirements of RSA 162-H and these rules.
