A person who is not physically qualified to drive due to having a physical deficiency, as listed in 49 CFR 391.41(b)(1)-(13), but who is qualified to drive a commercial motor vehicle pursuant to 49 CFR 391.11 and has not been disqualified pursuant to 49 CFR 391.15, shall be authorized to drive a commercial motor vehicle if the commissioner grants a waiver pursuant to Saf-C 909.09.
