- (a) Every law enforcement agent certified to conduct commercial motor vehicle inspections shall be authorized to declare a driver out-of-service upon discovering a violation of the out of service criteria.
- (b) A driver or motor carrier shall not require or permit an out-of-service driver to operate a commercial motor vehicle until that driver may do so lawfully.
- (c) The criteria to be used by the law enforcement agent for (a) above shall be the “North American Standard Out-of-Service Criteria” (April 1, 2023 edition). For those drivers of vehicles transporting highway route controlled quantities of radioactive materials, the criteria to be used by the law enforcement agent for (a) above shall be the “North American Standard Out-of-Service Criteria and Level VI Inspection Procedures for Commercial Highway Vehicles Transporting Transuranics and Highway Route Controlled Quantities of Radioactive Materials” (April 1, 2022 edition).
