- (a) If the state fire marshal, after reviewing the application, the competency test, and the background investigation, determines that the applicant is knowledgeable and qualified in the safe use, handling, and storage of pyrotechnic effects, special effects, or flame effects, they shall issue a license to the applicant to set up, load, and remove pyrotechnic effects, special effects, or flame effects before a proximate audience, performers, or support personnel.
- (b) A license shall be valid for a period of 3 years from the date of issuance, unless the license is suspended or revoked prior to the date of expiration.
- (c) A license shall not be transferred.
