Availability of Sample of Sufficient Quantity for Similar Testing

- (a) A blood or urine sample taken pursuant to RSA 265-A:4 shall be held for a period of 30 days following completion of testing, pursuant to RSA 265-A:7.
- (b) Pursuant to RSA 265-A:7, II, during the 30 day period referenced in (a) above, the subject or his or her counsel may request a sample of sufficient quantity to allow for similar tests to be completed in accordance with Saf-C 6402.16.
- (c) For the purposes of this section and Saf-C 6402.16, a sample of “sufficient quantity to allow for similar tests to be completed”, means an amount approximately equal to or greater than the volume used by the forensic laboratory for its testing of the sample.
