(a) Upon written request, the commissioner shall waive fees charged to a governmental entity or non-profit organization for good cause, consisting of the following:

1. (1) The fees requested to be waived shall consist only of fees charged for utilization of the fire academy facility;
2. (2) The governmental entity or non-profit organization shall request to utilize the fire academy facility during normal business hours at a time when the facility is available; and
3. (3) The governmental entity or non-profit organization shall not have had fire academy facility utilization fees waived in the previous 6 months.

(b) The governmental entity or non-profit organization shall be notified in writing whether the requested fee waiver has been granted, and if the request is denied, the commissioner’s decision shall be final.
