“Non-conviction data” means information indicating:
- (a) An arrest without disposition if one year has elapsed from the date of arrest and no active prosecution of the charge is pending;
- (b) That the law enforcement agency has elected not to refer a matter to a prosecutor;
- (c) That a prosecutor has elected not to commence criminal proceedings;
- (d) That proceedings have been indefinitely postponed; or
- (e) An acquittal or dismissal.
