1. (a) All congregate mooring fields shall have an operator. The operator shall provide the department with an emergency telephone number where a person who is responsible for the mooring field can be reached at all times.

2. (b) The operator shall:

   1. (1) Be responsible for the overall maintenance of the mooring field to ensure that the moorings are kept in good condition;
   2. (2) Assign moorings to members of the homogenous use group;

   3. (3) Maintain records that:

      1. a. Indicate the person to whom the mooring has been assigned;
      2. b. Include a legible copy of the boat registration for each boat assigned to a mooring in the field; and
      3. c. Indicate fees charged for use of the mooring; and
   4. (4) Have the records available for inspection by the director or his agents during weekday working hours.

3. (c) Operators of congregate mooring fields may include:

   1. (1) Government entities;
   2. (2) Corporations; or
   3. (3) Other persons.
4. (d) Fees charged pursuant to (b)(3)c. above, shall not exceed the reasonable cost of installing the mooring and the required maintenance.
