Reporting An Incident

- (a) An instructor may report an incident involving drug or alcohol use or possession by a student during any portion of the program to the division.
(b) Pursuant to RSA 263:59, the director shall revoke a driver education student’s license, as defined by RSA 259:48, upon receipt of information from the instructor that the student has:
- (1) Attended any driver education class(es) or related training under the influence of or in possession of an alcoholic beverage; or
- (2) Attended any driver education class(es) or related training under the influence or possession of a controlled drug or a controlled drug analog.
- (c) Each student whose license is sought to be revoked pursuant to this section shall be afforded notice and the opportunity for an administrative hearing.
- (d) All administrative hearings conducted pursuant to this section shall be in accordance with the provisions of RSA 263:59 and Saf-C 200.
