(a) Each pupil shall have a seat and shall not sit in the lap of another pupil, as follows:
- (1) On each type A, B, C, or D school bus, seating shall be provided to allow each pupil to be within the confines of the designed protective compartmentalization; and
- (2) On each multipurpose passenger vehicle, the number of pupils on a seat shall not exceed the manufacturer’s rated capacity.
- (b) No vehicle shall carry more pupils than its manufacturer's rated capacity, unless an emergency situation arises.
- (c) For the purposes of (b) above, an emergency situation shall include an accident or mechanical failure as long as every pupil can be seated in a seat.
