1. (a) A person may request the commissioner, in writing, to waive any portion of these rules, pertaining to equipment requirements.

2. (b) Each request for a waiver shall include the following:

   1. (1) The particular portion(s) of the rules pertaining to equipment sought to be waived;
   2. (2) A detailed explanation as to the reason for the waiver, to include the year, make, model, and VIN of the vehicle; and
   3. (3) A copy of the vehicle registration associated with such request.
3. (c) The commissioner shall review each request for a waiver and make a determination based upon the individual facts and particular reasons set forth in the request.

4. (d) The commissioner shall grant a waiver, in writing, in the event the waiver will not:

   1. (1) Interfere with the safe operation of a school bus; or
   2. (2) Have a direct impact upon the safety of the pupils.
