Hearing Procedures

- (a) The bureau of hearings of the department shall conduct administrative hearings based upon complaints involving violations of these rules.
- (b) All hearings shall be conducted in accordance with the provisions of Saf-C 200.
- (c) A hearing may result in the suspension of driving privileges, or revocation of school bus driving privileges, school bus inspection certificates, or registrations.
(d) A hearing shall be conducted if:
- (1) The division intends to suspend or revoke a school bus driver’s certificate based upon a written complaint received by the division that alleges an illegal or unsafe act by a school bus driver;
- (2) The issuance or renewal of a school bus driver's certificate is denied, and the applicant requests a hearing within 30 days of the denial; or
- (3) A person fails to obtain any permit, license, or registration, fails to file any report, or fails to pay any fees, penalties, or interest required by law or these rules.
(e) The complaint in (d)(1) above shall:
- (1) Describe the act;
- (2) State the identity or a description of the violator and the vehicle, if known;
- (3) State the time and place of the alleged violation; and
- (4) State the name and address of any witness.
