- (a) The purpose of a declaratory ruling under this part is to obtain from the ombudsman a statement as to the specific applicability of a statutory provision governing the office or any rule or order issued by the office.
- (b) A declaratory ruling under this part is not an alternative to the filing of a complaint under RSA 91-A:7-b in which the relief sought is primarily declaratory in nature, but rather is intended as a means to obtain a clear statement of general applicability regarding a statute or rule governing the operations of the office, or of a rule or order issued by the office.
- (c) A request for a declaration that a party has violated the provisions of RSA 91-A made in the course of a case shall not be construed by the office as a request for a declaratory ruling under this part, nor are declaratory orders of the ombudsman made in the course of a case a declaratory ruling under this part.
