1. (a) No manufacturer, wholesaler, retailer, or sampler shall engage in the business of selling or distributing tobacco products in this state without first:

   1. (1) Obtaining a license:

      1. a. If a manufacturer or wholesaler, issued by the department pursuant to RSA 78:6; or
      2. b. If a retailer or sampler, issued by the New Hampshire liquor commission pursuant to RSA 178; and
   2. (2) Registering with the New Hampshire secretary of state.
2. (b) Wholesalers and manufacturers shall apply for a separate license for each location where they sell tobacco products.
