“Utility” means any public utility as defined in RSA 362:2 owning, operating, or managing any plant or equipment or any part of the same for the transmission, distribution, or generation of electricity ultimately sold to the public within New Hampshire except:

1. (a) Municipal corporations, to the extent exempt pursuant to RSA 362:4-a;
2. (b) Entities specifically exempted from the definition of “public utility” pursuant to RSA 362:4-c; and
3. (c) Competitive energy suppliers that have not requested public utility status pursuant to RSA 374-F:7, I.
