- (a) The parties shall confer for the purposes of identifying and numbering exhibits and the petitioner shall submit a complete list of exhibits with the proposed numbering and document title.
- (b) At least 10 business days before a hearing, the parties shall file with the commission pre-marked hearing exhibits and proposed lists of witnesses to appear at hearing.
- (c) Parties shall present new exhibits at hearing based on a showing that the material is new or was otherwise unavailable by the applicable deadline, and after considering the probative value of the exhibit and whether the opportunity to submit a document impeaching or rebutting the late filed exhibit without further hearing shall adequately protect the parties' right of cross examination, the commission shall admit such additional exhibits.
- (d) New exhibits presented at hearing during cross-examination, for the purpose of impeachment, shall not be subject to the timeframe outlined in Puc 204.13(b).
- (e) A PDF version of Puc 204.13(f) shall be included, if feasible, in the pre-marked exhibits.
- (f) Exhibits in the form of any spreadsheets shall be submitted in live format with formulae and links intact as confidential pursuant to Puc 203.12 and shall maintain the same Bates number as the PDF version that was pre-marked pursuant to Puc 204.13(e)
