- (a) Parties to the docket that participate in settlement discussions shall treat such discussions as confidential and shall not disclose the contents of such discussions.
- (b) The commission shall approve a disposition of any contested case by settlement agreement, if it determines the settlement agreement is consistent with applicable law, is just and reasonable, and serves the public interest.
- (c) A proposed settlement agreement shall be filed no less than 15 business days prior to the hearing unless otherwise ordered, except as provided in (d). If a settlement agreement is filed late, the commission shall determine whether to reschedule the hearing based on the determination in (d).
(d) The commission shall accept a late-filed settlement agreement when such acceptance:
- (1) Promotes the orderly and efficient conduct of the proceeding; and
- (2) Will not impair the rights of any party to the proceeding.
- (e) In addition to, or in lieu of, filing a proposed settlement agreement, parties may file proposed findings of facts and conclusions of law for the commission's consideration.
